Judge: 'I Got Your Attention, Now Finish My Transcript'

FORT LAUDERDALE, Fla. -- They say timing is everything.
And one judge said a South Florida court reporter was out of order -- sending her to jail for the weekend.
"We're talking about tardy transcripts that were reportedly delaying a high profile child rape case, which ended almost a year ago," the judge in the case said.On Friday, Ann Margaret Smith was sent to jail, along with her typewriter so she could get the job done. She said she didn't meet her latest deadline for the transcript because her computer broke.Broward Circuit Judge Charles Greene had Smith arrested and held without bond on contempt of court, saying a child rapist's appeal for a new trial was being delayed.Greene said Smith was given various warnings and missed numerous deadlines, so that is why he sent her to jail for the weekend.Monday afternoon, Smith went in front of Greene again and asked for leniency.The case that started it all was one of a 2-year-old Pompano Beach boy who was kidnapped from his bedroom, covered in duct tape, and raped.The transcript is from the trial of Damion Winston Foster, who was convicted in April of abducting that 2-year-old boy. He was sentenced to three life terms, Greene said, but his appeal and the justice system has been grounded to a halt awaiting those transcripts."We are following the court's orders," Hugh Graff, of the Broward Sheriff's Office, said. "The judge has also ordered us to take necessary steps to make available to her the equipment and notes she needs to get those transcripts taken care of."Brought into the courtroom Monday, Smith was in a very different role that the veteran stenographer is used to.Greene held up the few hundred pages of transcript Smith completed over the weekend, but her attorney said that she would be able to complete much more if she were allowed to go home."Conditions that my mind is boggled with care about my kids, so at times I stray," Smith told Greene Monday. "I'm working, but my mind is focused on my personal life and my children, so that also impedes the labor because I am worried while I'm working."Greene told Smith that he thinks he got her attention with her weekend stint in jail and decided to put a GPS bracelet on her ankle and has ordered her to work from 8:30 a.m. to well into each night with hopes that the transcript will be done this week.
