Is The Party Over On Miami Beach?

POSTED: 4:47 pm EST January 18, 2007

A proposal to ban certain house parties in the city of Miami Beach is one step closer to reality.

The proposed ordinance would prohibit the commercial use of a single-family home, making it illegal to host a part where there's a sponsor or fee to get in.

A first reading of the ordinance was held on Wednesday night.

Many residents complained about the big parties in the city, but the ordinance was also met with opposition, forcing a change to the original proposal just 24 hours before the commission vote.

The ordinance would make it illegal for owners to receive payments or exchanged goods and services in excess of $100 for an event.

Alex Heckler, an attorney representing some of the homeowners, said the ordinance was too broad.

"The intent of the ordinance we support. However, the way it's written, it actually affects everyday homeowners and residents from having their own private events," Heckler said. "Any event where you receive over $100 in gifts, goods or services would, therefore, be illegal and you would be fined."

The fines range from $1,000 to $15,000.

"I think as far as the noise issue is concerned, that needs to be modified," resident Karyn Robinson said. "At 2 a.m., I don't want my kids coming downstairs saying they can't get to sleep because of noise."

One of the changes in the ordinance concerned charities. The city will allow homeowners to host a party for a charity as long as the homeowner gives a three-day notice.

Commissioners voted 6-1 in favor of the ordinance with some changes.

A second reading is scheduled for March 14.
